What is Compliance under Human Resource Management and Labour Laws



Statutory compliance mean the legal compliance as mentioned in the Statute books/laws/legislation applicable to any organization or vendors.

The obligation of compliance starts from the registration of the contractor, taking required license etc. to maintenance of registers and records, filing of periodical returns and observing the service conditions of employees including payment of wages, granting of leave, and providing them the facilities of health, welfare and safety.

If any organization/company is a contractor as defined under the Contract Labour (Regulations and Abolition) Act, then they have to comply with the provisions of this Act. They need to read the provisions, so that they can become familiar with the statutory obligations which been imposed on them by the Government.

NAIP-Providing Excellence through Professionalism
The launch of NAIP (NATIONAL ACADEMY OF INDIAN PAYROLL) in January 2010 in association with Maharashtra Institute of Technology (MIT-Pune) and its strategic partner the UK's Governing of Payroll The Institute of Payroll Professionals (IPP), is a significant milestone in the acceleration of India as a Provider of Professional Services.

Throughout the key global economies there exists Governing Bodies for all the major Professions and the Payroll profession is No exception, the UK has the IPP, USA has the APA, Canada has the CPA, yet India until now was not represented on a national or international forum. Now India joins the global payroll professional movement through NAIP.

NAIP in conjunction with its key strategic international partner the UK's IPP, will provide the much needed qualifications and training to not just the Payroll Practitioners but also to accountants, entrepreneurs, HR managers etc, the skills base is required across all industries and commercial sectors.

The provision of salaries and effective staffing is the single biggest expense to any organization or business, it is at the heart of the operation, one cannot afford any mistakes in this area.
NAIP will provide the kite-mark national standards in relation to the required qualifications; the qualifications being Post Graduate Diplomas are suitable to all graduates who are interested in further professional studies to better their chance of employment or promotional prospects. The qualifications are recognized by the UK Governing Body IPP.

The benefits continue as NAIP is a membership organization. On completion of the qualifications the student will be awarded with Full Professional Membership of NAIP allowing the student to be recognized as a true professional in this important profession, in addition to NAIP's membership the student will also attain International Membership of the IPP.

Calculations of ESI: ESI from Gross
Employee: 1.75%
Employer: 4.75%

Coverage: All the employees Drawing wages up to Rs.15, 000/- per month engaged either directly or thru’ contractor.

Expected activities:

1. Time of joining/at any time:

Form 01 : Employer Registration Form
Form 1 : Employee should fill, at the time of joining, Declaration form with postcard size
Photograph – due date within 10 days after the employees joins.
Form 1 A : Family Declaration Form, family details
Form 1 B : Changes in family declamation form, like family members…
Form 3 : Return of declaration form (Covering Letter) 3A continuation sheet/card,
Employer should fill. Male and female separately
Form 37: Employer should fill Certificate of Re-Employment / Continuing employment. With
Contribution period begin and end dates.
Form 105: Employer should fill, Certificate of Entitlement.
Form 72: Employee should fill, Application /form for changes in particular of insured
Person. Like local office, Dispensary/Address changes.

Register 7 : Individual Computation, there Gross salary, Days, ESI amt.
Information maintains month-wise.

Cards: Temporary & Permanent Cards.

Monthly Remittance / Challans:

1. Challans every month before 21st (3 copies/ quadruplicate)
2. Submit to Bank
3. Both employer & employee contribution
4. Cheque details.

Half year returns:
Contribution period:
1st April to 30th September.
1st October to 31st March

***42 days after closing Contn. Period (before Nov 11th. and next before May 12th)
